(구성):
…. 그교회의교인인모든연령층,
모든인종과신체장애자를포함시켜야한다.

“언제나 충분한기회를 회중에게주어서현장에서활동교인에의해공천하도록해야한다.”
=> 개정안: 회의석상 현장공천 조항 삭제 . 과거 PCUSA
교단의 헌법인 <규례서>에 의한 조항이었으며, 본 교회에서는 공천위원회의 역활을 존중하여 그동안 공동의회 석상에서 “현장공천”을 한번도 허락하지 아니하였으므로, 이 문구를 내규에서 삭제하는 것입니다.
(Organization):
This committee shall consist of selected representatives … including men
and women giving fair representation to all age groups, all racial ethnic
members, and persons with disabilities.
=> NEW: “including diverse category of
members.”
*Full
opportunity shall always be given the congregation to make nominations from the
floor.
=> Eliminate this “Floor Nomination Requirement” which was from PCUSA’s rule. Our
congregation has never allowed the Floor Nomination, instead empowering the
Nominating Committee to screen the potential candidates and honoring the
Nominating Committee’s service.

선거직공천업무를담당하며내규에정한자격요건을심사한후에후보명단을 [추가사항: “당회를 거쳐”]제직회에공천한후다시배수공천명단을받아서공동의회에공천한다.
(Responsibilities):
They shall be responsible for the nomination of elected officials. They shall screen the candidates for their
eligibility, <NEW add this clause: seeking affirmation of the
Session,> and submit the list of the eligible candidates to the Officers Meeting. Officers
Meeting shall recommend the candidates at least twice number of the total
vacancy. With this list, the Nominating Committee shall recommend the
same candidate's number of the total vacancy to the congregational meeting.

“정관” 개정에 관한 ECO 교단 요구조항
Revising the
Articles of Incorporation according to the ECO requirement
[배경] ECO교단에서는 본 교회가 미연방 국세청 규정 501(c)(3)에 부합하는 세금공제 혜택을 받는 비영리 종교기관으로 법인체의 존립목적을 명시하고, 개인의 유익추구 금지, 정치적 활동 금지, 그리고 법인체 해산시에 재산권 사후처리 조항을 추가할 것을 요구합니다.
이에 따라 현재 정관 5조, 6조를 다음의 내용으로 보강, 교체할 것을
당회는 온 회중 앞에 제안하는 바입니다.
Our new
denomination ECO requires us to amend our Article of Incorporation with
specific wording so that we may be covered under the ECO’s IRS 501(c)(3)
tax-exempt, non-profit religious organization status. This requires us to replace article 5 &
article 6 of our current Art. of Incorp. with new wording, which is presented
below.

6: The purposes of the Church are:
1)
성경을토대로한복음언약장로교 헌법과한국장로교회의문화와전통에 의거하여하나님께예배드린다. To worship God in accordance with ECO's Book
of Order and the culture and tradition of Korean Presbyterian Church based on
biblical principles.
2)
전도와선교를통하여그리스도의 복음을만민에게전파한다. To preach the Gospel to the world through
evangelical and missionary works.
3)
교육과 훈련을통하여그리스도의제자를양육한다. To nurture disciples of Christ through
education & training.
4)
우리의이웃과세계의불우한사람들을돕기위해구제및봉사활동을 전개한다 To help our neighbors and the needy of the
world through charity and volunteer services.
5)
이땅에예수그리스도의복음을위하여국내외의기독교교회및기관들과유대를강화한다. To cooperate with local & global
Christian organizations and churches to preach the Gospel of Jesus Christ
to the ends of the earth.

V. Established as a Non-Profit Religious
Organization
제5조
비영리 종교기관으로 설립목적 명시
Section 1. This
corporation is organized and operated exclusively for charitable, religious and
educational purposes within the meaning of section 501(c)(3) of the Internal
Revenue Code of 1986, as amended, or the corresponding provision of any further
United States internal revenue law or successor statute (“Code”). Consistent with and subject to its
qualification under section 501(c)(3) of the Code, the corporation is organized
and operated as a church, to engage in religious activity; worship,
instruction, fellowship and mission activity; to hold, operate and maintain
facilities necessary therefore; and to receive and disburse offerings for these
purposes.
제1항 본 법인체는 1986년도 미연방국세청 시행령 501(c)(3) 조항과 그 이후 개정되는 미국연방법이 규정하는 비영리기관으로, 오직 종교적 그리고 교육적인 목적을 위해 조직되고 운영된다. 이 세법 501(c)(3) 조항에 준하여, 본 기관은 교회로 조직, 운영되어 다음과 같은 종교적인 활동을 수행하되, 예배, 교육, 교제와 선교활동을 수행하며, 이런 활동에 필요한 시설과 건물을 소유, 운영, 유지함과, 이런 목적을 위한 헌금을 수납하고 집행한다.
Section 2. [개인의 유익 추구 금지] No part of the net earnings of the corporation shall
inure to the benefit of any private shareholder or individual.
제2항 법인체 수익의 어떤 부분도 특정 멤버 또는 개인의 유익을 위해 쓰일 수 없다.
Section 3. [정치적 선전활동 금지] No substantial part of the activities of the
corporation shall be the carrying on of propaganda, or otherwise attempting to
influence legislation (except otherwise provided in Section 501(c)(3) of the
Code).
제3항 법인체 활동의 주요부분이 정치적인 선전이나, 입법과정에 영향을 행사할 수 없다.
(미연방 세법 501(c)(3)조항이 허락한 것은 제외함.)
Section 4. [특정후보나 정치적 선거운동 금지] The corporation shall not participate in, or intervene
in (including the publishing or distributing of statements), any political
campaign on behalf of (or in opposition to) any candidate for public office,
all within the meaning of Section 501(c)(3) of the Code.
제4항 미연방 세법 501(c)(3)조항에 의거하여,
본 법인체는 어떤 공적인 선거직 후보의 정치적 선거운동에 찬성 또는 반대하는 일체의 활동에 (공식입장을 발표하거나 배포하는 일을 포함) 참여, 또는 개입할 수 없다.
Article VI. 제6조
법인체 해산시 재산 사후처리 조항
(신설조항으로 Gig Harbor의 채플힐 장로교회의 정관 내용을 참조하였고, ECO교단 본부에서 보내온 자료와 동일한 내용임)
In the event
of dissolution of the corporation, the net assets are to be distributed as
follows:
The net assets
shall be distributed to one or more 501(c)(3) tax-exempt nonprofit Christian
religious organizations, chosen by a majority vote of the then sitting TCPC
Session. In the absence of a functioning
Session or other identifiable church leadership team of elders poised to direct
TCPC’s net assets, the net assets shall be distributed as per the majority vote
of the last sitting Session prior to dissolution or any entity appointed to do
business in the case there is no session-entity at the time of dissolution.
본 법인체가 해산될 경우, 남은 자산은 다음과 같이 처분된다.
잉여 자산은 501(c)(3)조항에 준하는 세금공제 비영리 기독교 기관(들)에 기증하되, 법인체 해산 당시 본교회 당회의 과반수의 결정으로 기관을 선택한다.
정상적으로 활동하는 당회가 존재하지 않거나, 본 교회의 잉여자산을 처분할 권한을 가진 교회 리더십팀이 존재하지 않을 시에는, 법인체가 해산되기 전, 당회가 없는 상황에서 교회를 운영할 권한을 수행할 기관이 가동되기 전, 마지막 당회의 과반수의 결정으로 선택된 기관에 기증된다.

Any
organization that the sitting members of the Session holds a major office shall
be excluded from consideration as a potential recipient nonprofit organization,
to prevent any conflict of interest.
이해갈등을 예방하기 위해, 당회원이 주요 임원으로 활동하는 기관은 잉여 자산 기증 대상에서 제외된다.
